Mandated Supervisor/Faculty Training:
Who is a Supervisor?

Here are specific and revised guidelines with respect to supervisor status and who is required to complete the state mandated 2 hr. sexual harassment training for supervisors every 2 years. We have developed these guidelines based on information we have about duties undertaken by staff and faculty in these various categories. However, the bottom line is that all employees who are supervising must participate in sexual harassment training mandated by AB1825 every two years.

Definition of Supervisor:
A supervisor is anyone who supervises, directs or evaluates the work of one or more employees or student employees (including TA’s, RA’s, casuals or temps) or who is an Academic Council faculty member (tenure line, research, teaching, performance). The Provost has designated that all Academic Council faculty members and Senior Lecturers will be defined as “supervisors” for purposes of this training mandate whether or not they supervise or direct the work of others.

Faculty: YES
Tenure-Line Professors (Assistant, Associate or Full), Academic Council faculty, Senior Lecturers, Med Center-Line Professors or Clinician Educators.

Staff Supervisors: YES
See “Definition of Supervisor” above. A supervisor does not need to have the words “supervisor” or “manager” as part of their job title. Administrative associates can be supervisors if they supervise, direct or evaluate the work of other employees, even if those employees are temps or students.

Senior Lecturers/Artists in Residence: YES

Lecturers: GENERALLY, NO
We have made this decision based on what we understand to be the general job duties of lecturers. Therefore, we don’t want to mandate this training for lecturers across the board. However, we do want to make sure we require the training for the lecturers who do act as supervisors for TA’s or others:

Senior lecturers are considered supervisors whether they supervise or not, but lecturers need to be determined on a case-by-case basis. A lecturer needs to comply with this training requirement if: he/she supervises, directs or evaluates the work of one or more employees or student employees (including TA’s, RA’s, casuals or temps).

Emeritus Professors: GENERALLY, YES
Unless Emeritus Professors can establish that they have no supervisory duties, they will be considered “supervisors” for the purpose of mandated sexual harassment training. (If their duties are limited to overseeing the academic work of students and evaluating students, then they are not supervisors). Since their duties vary, we prefer to have the default be that they are included in those who must complete the training.

Visiting Faculty/Consulting Faculty/Acting Faculty/ Senior Fellows: GENERALLY, YES, if appointment is for 6 months or longer, even if not on Stanford payroll
Unless the groups listed above can establish that they have no supervisory duties, they will be considered “supervisors” for the purpose of mandated sexual harassment training. (If their duties are limited to overseeing the academic work of students and evaluating students, then they are not supervisors).

School of Medicine Clinician Educators:
Generally, YES.

Regular CE's, regardless of their %FTE at Stanford, will be considered "supervisors" for the purpose of mandated sexual harassment training. If a CE has no supervisory duties at Stanford s/he may be exempt from the training requirement. Since the duties of Clinician Educators vary, we prefer to have the default be that they are included in those who must complete the training, unless we are informed,with FAA corroboration, that they do not supervise.

CE affiliates do not have to take the training.

CE’s who provide clinical services at affiliated institutions (VA, Santa Clara County, Kaiser): YES
Since they are typically employed by third parties, they must provide proof of AB 1825 training to SHPO.

School of Medicine Adjunct Clinical Faculty:
NO, because they do not perform supervisory duties at Stanford.

Faculty on sabbatical or staff/faculty on leave: YES, WITHIN 90 DAYS OF THEIR RETURN
If on sabbatical or on leave, the training must be completed within 90 days of their return. Faculty/staff will be notified to sign up for training.


Other FAQ’s:

What about supervisors. visiting faculty/consulting faculty/acting faculty/ senior fellows, whose appointment at Stanford is for less than six months: NO
As a general rule, if an appointment is for less than six months, they are exempt from this training requirement (those invited to teach a class for one quarter, for example). However, if that visiting professor has an ongoing appointment and teaches for one quarter every year, they would need to complete the training.

What about those who would be defined as a supervisor, but who work less than full time: YES
The amount of time worked is immaterial; whether there is supervisory responsibility or not is the deciding factor.
